The 2026 National Electrical Code is picking up momentum, and expanded surge protection requirements are coming along for the ride.
For contractors, this is not about learning a brand-new product category. It is about knowing where surge protective devices are now required, building them into the bid, and having the right product on hand before inspection day.
As of current NEC enforcement tracking, several states have projected 2026 effective dates underway:
- Wyoming: July 1, 2026
- Texas: September 1, 2026
- Oregon: October 1, 2026
- Washington: December 31, 2026
Additional states are also in the 2026 NEC update process with no effective dates currently established, including Massachusetts, Minnesota, Nebraska, North Carolina, North Dakota, South Carolina, and Virginia.
Other states are still implementing the 2023 NEC, including Connecticut, Florida, Indiana, and Maryland. That matters because the 2023 NEC already expanded SPD requirements beyond dwelling units to include dormitories, hotel and motel guest rooms and suites, and patient sleeping rooms in nursing homes and limited-care facilities.
State adoption timelines can shift, and local enforcement can vary, so contractors should always check the latest NEC enforcement map before finalizing scope. But the direction is clear: More jurisdictions are moving forward, and surge protection planning needs to keep pace.
A Pattern Three Cycles in the Making
Surge protective device (SPD) requirements have been included in the NEC for some time. The 2020 NEC first mandated SPDs for services supplying dwelling units. In 2023, the NEC expanded these requirements to include dormitories, hotel and motel guest rooms, and nursing home patient sleeping rooms. The trend continues with the upcoming 2026 NEC, and contractors in the aforementioned should prepare for these changes.
What's New Under 230.67
The 2026 NECC introduces a new requirement in Section 230.67(A) for specific locations: areas intended exclusively for sleeping quarters in fire stations, police stations, ambulance stations, rescue stations, ranger stations, and similar facilities. Any electrical service supplying these types of facilities must now include a Type 1 or Type 2 SPD, which should be either integrated into or positioned immediately adjacent to the service equipment. This requirement mirrors the placement standards established for dwelling units since 2020.
This change is important for contractors working on projects involving municipal or first-responder facilities. The sleeping quarters in these buildings now have the same surge protection obligations as hotel guest rooms or private homes.
New Protection for Replacement Manufactured Homes
A new section, 550.51(E), addresses a gap that has existed since SPDs became mandatory. Previously, the code required surge protection when new service equipment was installed, but it did not explicitly require it when existing service equipment was reconnected to a replacement mobile or manufactured home. Under the 2026 NEC, this reconnection now triggers the same SPD requirement found in section 230.67. For contractors who regularly replace homes within existing manufactured housing communities, this change effectively closes a common loophole.
Service Level Isn't the Only Level
The 2026 NEC clarifies a long-standing uncertainty regarding feeders. When a service supplies only feeders and no SPD is required at the main service panel, an additional SPD must now be installed at the subpanel on the load side of that feeder. This requirement applies if the downstream distribution equipment serves any of the occupancies listed in section 230.67(A). In simple terms, it's not enough to protect just the main service panel. If a feeder goes to a subpanel that serves a protected occupancy, that subpanel also requires its own SPD. The intent of the code is clear: surge protection is most effective when installed as close as possible to the point of use, rather than only at the point of entry.
What This Means for Your Bids
Between now and your state's effective date, expect surge protection requirements to expand into more areas than before, including emergency services work, reconnections for manufactured housing, and multi-panel commercial or institutional projects where feeders supply sleeping accommodations. Incorporating this into your estimates and material planning now will help you avoid change orders and inspection delays when enforcement begins.
